Property Listing Terms and Conditions

Agreement

By subscribing for the Service provided by NM Real Estates you agree to be legally bound by the following terms and conditions which are valid for the use of this Service. The terms and conditions may be changed at any time without notice. You are advised to review them regularly and agree to be bound to the current version.

The Service we provide imply to the following: providing estate agents/ individuals with an access to NM Real Estates' Administrative panel for the uploading of properties, property details and images (listings) on NM Real Estates' Uploading Property Section.

We are not under any obligation to monitor or censor the listings published by agents/ individuals on NM Real Estates' website, however we reserve the right to do so.
You guarantee that you have read and agree to be bound by the terms of all legal notices published on nmrealestates.com

Terms and conditions of use

By contributing to NM Real Estates you grant us a perpetual, royalty-free, non-exclusive right and license to use, reproduce, modify, publish, translate, create derivative works from, distribute, make available to the public, and exercise all copyright and publicity rights worldwide and/or to incorporate your contribution in other works in any media. You acknowledge that you are fully responsible for the legality of the published listing, also its reliability, appropriateness, originality and copyright. You hereby represent and warrant that the content of your listing does not infringe the rights of any third party.

NM Real Estates reserves the right to not accept, remove or delete any listing and to suspend temporarily or permanently your account if we consider a breach of these Terms and Conditions or/and the Property Listing Rules has occurred.

Your obligations

You warrant that you have been authorized to advertise a property for sale or lease by the owner or you are the owner of the respective property in order to receive an access to NM Real Estates database and Administrative panel.  You warrant that you are of legal age to create binding legal obligations for any liability that may incur as a result of your use of the Service. You agree that you are responsible for all of your use of the Service, including the use of your account by others, authorized or otherwise; and that you are responsible for the accuracy and the integrity of the material published by you.

You must only upload properties that are currently available for sale or lease. When a property is sold it should be removed or marked as sold and then removed from the Agent/ Individual advertising it within 3 days of the sale. If a property is listed with different agents, only the selling agent should mark it as sold.
You guarantee that any material you publish through the Service is lawful and closely relevant to the subject of the Service. The uploading of defamatory, misleading or deceptive information or information that breaches copyrights and would therefore expose us to any liability is considered a breach of these Terms and Conditions.

You agree not to make any reference to us or our web site in order to promote your business, particular properties for sale and lease or third parties/ partners, without our express prior written permission.

Initial Terms and Fees

The subscription and using of the service provided by NM Real Estates is free of charge.

Suspension, Cancellation or Termination

Without limiting our other rights, we may immediately suspend the account of any Agent/ Individual or/and remove or delete at any time any listing if and when a breach with these Terms and Conditions or Property Uploading Rules occurs.

In case of suspension of your account we shall provide you with 7 days notice, starting from the day of suspension, sent by e-mal, you should rectify that breach.

Indemnity

You agree to indemnify, defend, and hold harmless NM Real Estates and its owners, employees, shareholders, directors and suppliers against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses, arising out of or related to a breach of this Agreement, the use or the inability of use of this Service, or any claim by a third party related to the use of the Service.

Liability

You must take all reasonable care to ensure that the information provided through this Service on this web site is accurate. NM Real Estates does not guarantee the accuracy and legality of the advertisements uploaded by any agent/individual with access to NM Real Estates' Administrative panel and therefore can not be held responsible for any advertisements which contain inaccurate information.

You guarantee that you own the copyright of the images you publish on NM Real Estates or have been authorized by the owner of the images to do so. NM Real Estates cannot be held responsible if an infringement of copyright occurs due to an agent/individual negligence.

Disclaimer

NM Real Estates does not accept liability of any kind including negligence for any damages or loss of data or profits occurring out of or in connection with the use of your account or the use or performance of this Service. Errors may occur as a result of a probable technological failure, we can not be held responsible if such errors occur and temporarily suspend the access to your account and NM Real Estates' agents/individuals Administrative panel.

General

Nixen Master Ltd (the owner of NM Real Estates) is based and was established in England and therefore this Agreement is subject of and is governed by the laws of England and Wales only.
We may contact you via email and other electronic media from time to time to promote appropriate products and services offered by us, unless you notify us that you do not wish to be contacted.
If any part of the Agreement is or may be considered for any reason invalid or unenforceable at law, the validity and enforceability of the remainder in any event shall continue in effect. No delay or failure by us to enforce any clause of this Agreement will prejudice our rights.
