Terms and conditions of use

You warrant that you are of legal age to use the website and to create binding legal obligations for any liability that may incur as a result of your use of the website. You agree that you are responsible for all of your use of the site, including the using of your account by others. If you have entered the site from a country where any part of the website’s content is illegal or abusive, please, leave the website immediately. Nixen Master Ltd (the owner of NM Real Estates) is based and was established in England and therefore all content of the site is subject of and applies to the laws of England and Wales only.

By contributing to NM Real Estates you grant us a perpetual, royalty-free, non-exclusive right and license to use, reproduce, modify, publish, translate, create derivative works from, distribute, make available to the public, and exercise all copyright and publicity rights worldwide and/or to incorporate your contribution in other works in any media. You acknowledge that you are fully responsible for the legality of the published advertisement, also its reliability, appropriateness, originality and copyright. You hereby represent and warrant that your advert does not infringe the rights of any third party.

NM Real Estates reserves the right to not accept, remove or delete any advertisement which is illegal, abusive or disrespectful towards any religion, culture, society, or for spreading hate or discrimination, or to defame or victimize other people; also for pornographic, unlawful or any other immoral purposes.

NM Real Estates and all content of NM Real Estates are protected by copyright, trade marks, database and other intellectual property rights. NM Real Estates reserves the right to publish advertisements in any of its other publications. You may not copy, reproduce, distribute, publish, create derivative works, store electronically, transmit or in any way exploit for commercial gains or otherwise, any content on NM Real Estates without a written permission. You may use the content of NM Real Estates for your own personal, non-commercial use only.

NM Real Estates does not accept responsibility for any loss or damage caused by an error, inaccuracy or omission in its listing; for any failure to publish an advertisement in our Basic Listing in period of up to 3 weeks; for any failure to publish an advertisement in our Premium Listing within 2 days due to technical inability or however caused.

Please, note that we may keep record of all IP addresses of people or companies, advertising on the website. NM Real Estates reserves the right to to pass your details and IP address on to a concerned third party, their agents or any law enforcement agency in case you provide false contact details or impersonate another party.

NM Real Estates can not be held responsible in case of a fraud. The visitors of the website are strongly advised to check the authenticity of an advertiser before taking any further action.

Suspension, Cancellation or Termination of services

Without limiting our other rights, we may immediately suspend, remove or delete any website from our listing at any time if they are in breach with our Submission Rules or these Terms and Conditions.
In case of suspension, we shall provide you with 7 days notice, starting from the day of suspension, sent by e-mal, in which period you are obligated to rectify that breach. If you fail to do so our agreement becomes invalid, however you acknowledge and agree that cancellation of this agreement does not relieve you of obligations and liabilities pursuant to the Agreement.
We require 7 days notice, sent by e-mail or prepaid post, in case you decide to terminate this agreement. We will not refund any payments made in respect of the remainder of the period.

This website may contain links to other websites. We have placed those links for your convenience and information only and, as such, you access them at your own risk. We do not control the content and design of other websites; therefore we take no responsibility for their contents. You must understand that third party products, services and information are not provided or endorsed by us and your legal relationship is with the third party supplier only.

Indemnification

You agree to indemnify, defend, and hold harmless NM Real Estates and its owners, employees, shareholders, directors and suppliers against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses, arising out of or related to a breach of this Agreement, the use or the inability of use of this site, or any claim by a third party related to the use of the site.

Liability

NM Real Estates accepts no responsibility and shall not be liable for any damage to, or viruses which may infect your computer equipment or other property by reason of your access to, browsing or use of this website.
Under no circumstance shall NM Real Estates be liable for any damages, losses, injuries or claims or any direct, indirect, incidental, consequential damages of any kind (including but not limited to lost profits, data or savings) however arising (including, but not limited to, as a result of our negligence) in connection with the use of this website; or the copying or use of any information or material contained in or referred to in this website; or any failure or delay of the use or inability to use any component of this website.

Disclaimer

We reserve the right to amend the information on this website (including these terms and conditions) at any time. General

This agreement shall be governed by the laws of England and Wales. Therefore any English and Welsh court shall have exclusive jurisdiction to adjudicate any dispute which may arise out of the use of this website.
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations, then the invalid or unenforceable provision will be superseded by a valid, enforceable provision which most closely matches the intent of the original provision and in any event the remainder of the agreement shall continue in effect.
